These Terms of Use (the "Terms" or "Agreement") govern your use of the mobile game TEGRA (the "Game" or the "Application"), developed and published by Avega Games ("Licensor", "we", "us"). By downloading, installing or playing the Game from Google Play or the Apple App Store you agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the Game.
Google LLC and Apple Inc. are not parties to this Agreement and have no obligations regarding the Game, except as stated in section 14. Avega Games, not Google or Apple, is solely responsible for the Game and its content.
TEGRA is a free-to-play survival game for Android and iOS devices. It is provided for entertainment purposes. The Game contains advertising and offers optional in-app purchases (section 5).
You must be at least 13 years old (or the higher minimum age required in your country for consenting to data processing, for example 16 in parts of the European Economic Area) to use the Game. If you are between the minimum age and 18, you may use the Game only with the permission of a parent or legal guardian, who agrees to be bound by these Terms and is responsible for any purchases made. We may restrict or terminate access if we learn that a user does not meet these requirements.
3.1 We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and play the Game on devices that you own or control, for your own non-commercial entertainment, in accordance with these Terms and the Google Play Terms of Service or Apple Media Services Terms, as applicable.
3.2 This license also covers updates and patches to the Game unless a separate license accompanies them.

4.1 You can play without an account; in that case your progress is stored only on your device. Signing in with your Google account (Android), Game Center or Sign in with Apple (iOS) enables cloud save so that your progress can be restored on another device. You are responsible for keeping access to that platform account secure.
4.2 You may delete your account at any time in the Game settings or as described at avegagames.com/legal/tegra-data-deletion.html. Deleting an account permanently removes the associated progress and virtual items; they cannot be restored or refunded.
4.3 The name you give your character is not shown to other players. It must nevertheless not be offensive, impersonate another person or infringe anyone's rights, and we may change or remove names that violate this rule.
5.1 Virtual items. The Game contains virtual currency, resources, weapons, equipment, boosts and other virtual items ("Virtual Items"). Virtual Items are licensed to you, not sold; you receive a limited, revocable right to use them inside the Game. They have no real-world monetary value and cannot be exchanged for money or transferred outside the Game. We may modify, rebalance, replace or remove Virtual Items as part of the ongoing development of the Game.
5.2 Purchases. Some Virtual Items and features can be purchased for real money. Purchases are consumable one-time purchases; the Game does not offer subscriptions. All purchases are processed by Google Play or the Apple App Store under their terms; we do not receive your payment card details. Prices are shown before you confirm a purchase and may vary by region.
5.3 "No Ads" purchase. The "No Ads" item disables interstitial (full-screen) advertisements for the period stated in the offer. It does not disable rewarded advertisements that you choose to watch for a bonus. Once the period ends, interstitial advertisements resume unless you purchase the item again.
5.4 Refunds. Refund requests are handled by Google Play or Apple under their respective policies. Except where required by law, purchases of Virtual Items that have been delivered are not refundable.
5.5 Rewarded ads, promo codes and free rewards. Some Virtual Items can be earned by watching optional rewarded advertisements or completing in-game activities. Availability of such offers is not guaranteed and may depend on region, device and advertising inventory. Our support team may also issue individual promo codes, for example as compensation for a bug or lost progress; such codes are granted at our discretion, have no monetary value, may be limited in time or number of uses, and may be withdrawn at any time.
The Game is funded by advertising. By using the Game you agree that we may show advertisements from third-party networks, including full-screen interstitial ads between game screens and optional rewarded video ads. Interstitial ads can be removed for a period of time with the "No Ads" purchase. How ads use your data, and how to opt out of personalised ads, is described in our Privacy Policy. We are not responsible for the content of third-party advertisements or for the websites or apps they link to.
Our collection and use of personal data in connection with the Game is described in the Privacy Policy, which forms part of these Terms.
8.1 We may release updates that add, change or remove content and features, rebalance gameplay or fix problems. Some updates may be required to continue playing. We are not obliged to provide any particular update or to support any particular device or operating system version.
8.2 Certain features (cloud save, remote configuration, advertising, purchases) require an internet connection and depend on third-party services. We do not guarantee that the Game or any feature will be available at all times, and we may suspend or discontinue the Game or any part of it, with reasonable notice where practicable. If we discontinue the Game entirely, unused Virtual Items will lose their function without compensation, except where required by law.
The Game requires Android 8.1 or later, or iOS 13 or later, and a device with sufficient memory and storage. We recommend keeping your operating system up to date. It is your responsibility to check that your device meets these requirements before downloading the Game.
Avega Games is solely responsible for support of the Game. You can reach us at tegra-support@avegagames.com. Google and Apple have no obligation to provide maintenance or support for the Game.
The Game, including its software, graphics, characters, sounds, music, text, names and logos, is owned by Avega Games or its licensors and protected by copyright, trademark and other laws. Nothing in these Terms transfers any ownership to you. If a third party claims that the Game infringes its intellectual property rights, Avega Games, not Google or Apple, is responsible for investigating, defending and settling such claims.
To the maximum extent permitted by law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Game will be uninterrupted, error-free or free of harmful components, or that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. If the Game fails to conform to a warranty that cannot be excluded, you may notify Google Play or Apple, who may refund the purchase price of the Game (if any); to the extent permitted by law they have no other warranty obligation.
To the maximum extent permitted by law, Avega Games and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising out of or in connection with the Game or these Terms. Our total liability for all claims relating to the Game is limited to the amount you paid us for the Game in the twelve months before the claim arose, or USD 50, whichever is greater. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited by law.
14.1 Your use of the Game is also subject to the Google Play Terms of Service or Apple Media Services Terms and Conditions. In case of conflict between those terms and this Agreement regarding the platform's obligations, the platform terms prevail.
14.2 Google and Apple, and their subsidiaries, are third-party beneficiaries of this Agreement and, upon your acceptance of these Terms, may enforce them against you.
14.3 The Game uses third-party software and services (game engine, analytics, advertising networks and sign-in providers). Their use is subject to their own terms; the current list is in our Privacy Policy.
You represent that you are not located in a country subject to a comprehensive U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
This Agreement remains in effect until terminated by you or by us. You may terminate it at any time by uninstalling the Game and deleting your account. We may suspend or terminate your access to the Game, without notice, if you breach these Terms - including by cheating, abusing other players or attempting to defraud us or the stores. Upon termination you must stop using the Game and delete all copies. Sections 3.3, 5, 11, 12, 13, 17 and 18 survive termination.
This Agreement is governed by the laws of the Republic of Cyprus, excluding its conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside. Before starting any legal proceedings, please contact us at tegra-support@avegagames.com - most issues can be resolved quickly and informally. Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
18.1 If any provision of these Terms is found invalid, the remaining provisions remain in effect and the invalid provision will be replaced by a valid one that most closely achieves its purpose.
18.2 These Terms, together with the Privacy Policy, are the entire agreement between you and Avega Games regarding the Game. Changes to this Agreement are only valid in writing.
18.3 We may update these Terms from time to time. The "Last updated" date shows the latest revision. Material changes will be announced in the Game or on our website; continuing to play after the changes take effect means you accept them.
18.4 We may assign this Agreement to an affiliate or a successor in connection with a merger, acquisition or sale of assets. You may not assign it.
